Terms of Service

These terms apply when you buy from mansahaus.com. They are written to be read, not to be survived. Nothing here excludes, restricts or modifies any right you have under the Australian Consumer Law.

1. Who you are dealing with

The seller is Mansahaus Pty Ltd (ABN to be confirmed), an Australian company. "We" and "us" mean Mansahaus; "you" means the person placing the order.

2. Made-to-measure orders

Each awning is manufactured to the width and projection you specify. Because of that:

• Your order is an offer. It becomes a contract when we send you an order confirmation, and manufacture begins only after you approve the drawing we send you.
• You are responsible for the measurements you give us. We will sanity-check them against the wall type and photos you send and will tell you if something looks wrong, but we build to the approved drawing.
• If we discover we cannot build what you ordered — an unsuitable wall, a span beyond what the frame supports — we will tell you and refund in full rather than build something that will fail.

3. Prices and payment

All prices are shown in Australian dollars. Where GST applies to your order it is included in the price shown and itemised on your tax invoice. The price shown at checkout is the price you pay: it already includes metro delivery, and any regional freight is added and shown before payment, never afterwards. Payment is taken in full at checkout. We may correct an obvious pricing error before manufacture begins; if we do, you may cancel for a full refund.

4. Delivery and risk

Delivery timeframes on our Shipping page are estimates given in good faith, not contractual deadlines, and they do not affect your consumer-law rights if delivery is unreasonably delayed. Risk passes to you on delivery to your nominated address. Title passes when payment clears in full.

5. Cancellation, returns and warranty

6. Installation and safety

You are responsible for installation unless we have agreed in writing to arrange it. The awning must be fixed in accordance with the supplied bracket schedule into sound structure, and any 240 V connection must be made by a licensed electrician. We are not liable for loss caused by installation that departs from those instructions, or by use of the awning outside its 40 km/h wind rating.

7. Our liability

Where the Australian Consumer Law applies, our liability for a failure to comply with a consumer guarantee is as that law provides, and where the law permits us to limit liability for goods not of a kind ordinarily acquired for personal or domestic use, we limit it to replacement, repair, or payment of the cost of replacement or repair. Subject to that, we are not liable for indirect or consequential loss, and nothing in these terms operates to exclude a liability that cannot lawfully be excluded.

8. Intellectual property

The Mansahaus name, logo, photography and page copy are ours. You may not copy them for commercial use. Customer photographs sent to us may be used in reviews and marketing unless you ask us not to — just say so and we will remove them.

9. Reviews and content

Reviews on this site are published as received, edited only for length and obvious typos. If you believe a review is inaccurate, tell us and we will investigate.

10. Changes to these terms

We may update these terms; the version that applies to your order is the one published when you placed it. Material changes will be noted with a revision date at the foot of this page.

11. Governing law

These terms are governed by the law of New South Wales, Australia, and the courts of that state have non-exclusive jurisdiction. This does not prevent you from bringing a claim in your own state where the law allows it.
